Terms of sale

The contract between TariffTrust EI and the business that subscribes to TariffTrust. Prices and the rights of each plan are shown on the pricing page. Effective November 2, 2026.

TariffTrust is operated by TariffTrust EI, France. Hosting: Amazon Web Services, Inc., 410 Terry Avenue North, Seattle, WA 98109-5210, United States, +1 206 266 1000. Questions about the service: support@tarifftrust.com; invoices and payments: billing@tarifftrust.com; legal notices under these terms, and the single point of contact for authorities and for notices of illegal content under the EU Digital Services Act: legal@tarifftrust.com.

For businesses only

TariffTrust is offered only to businesses and professionals, for the purposes of their trade, business or profession. By creating an account or a workspace, or by subscribing, you confirm that you act for such a business and that you may bind it to these terms. TariffTrust is not offered to consumers, and the rules that protect consumers in distance sales do not apply to it.

The service

TariffTrust provides informational estimates of US import duties and entry fees, each with its official sources. It is not a customs broker and gives no customs determination, ruling or legal advice; the importer of record remains responsible for the entry. See the limits of the service.

What we commit to

We take care that each estimate is exact and sourced, and that the service stays available: a commitment to reasonable care and effort, not to a result. We do not guarantee that an estimate is free of error or that the service is never interrupted. When a published rate proves wrong, we follow the incident procedure of the limits of the service: the estimates concerned are suspended, you are told, then they are corrected. You are responsible for the codes, origins, values and answers you enter, and for checking an estimate before relying on it. Duties, fees, interest and penalties claimed by an authority are owed by the importer, whatever an estimate said.

Liability

We are liable only for direct and foreseeable damage caused by our fault. We are not liable for lost profit, revenue, business or data, or for duties, fees, interest or penalties owed to an authority. Our total liability under these terms is limited to the amounts paid for the workspace in the twelve months before the event that caused the damage, and is at least USD 500. These limits do not apply to gross negligence or wilful misconduct, or where the law forbids them.

Use of the service

Access and API keys are for your business's own use; keep keys secret, as they act for your workspace. Do not resell or redistribute the service or its results, except under an Enterprise contract, and do not bypass quotas, rate limits or security.

Plans and quotas

Each plan includes a monthly quota of estimates and API requests (the portal, the API and the MCP together), of assistant messages, members and tracked products. Quotas renew every month, including on a yearly plan. The workspace is told once per quota period when it reaches 80 % and then 100 % of a quota.

Free trial

A free trial of 14 days is offered once per person, with a payment card: an email address under another alias, or a new account after a deleted one, does not open a second trial. Its end date and its consumption are kept: choosing a yearly price during the trial opens neither a new trial nor a paid quota.

Yearly plans

A yearly plan is a 12-month commitment paid in advance, in return for three months offered. A reminder is sent before each yearly renewal.

Changing plan

Plan changes and cancellation are made in Stripe's billing portal, opened from the Billing page.

  • Upgrade: immediate. The invoice credits the unused time of the previous plan and charges the new plan for the same time; the new plan's rights apply once this invoice is paid.
  • Downgrade: immediate. The unused time of the previous plan becomes a credit on the next invoices; it is never refunded.
  • Yearly to monthly on the same plan: at the end of the paid year, without credit or refund.
  • A change at equal interval keeps the current quota window and its consumption, under the new limit; a change of interval starts a new window once its payment is confirmed.

Cancellation

You can cancel at any time, on a monthly or a yearly plan, from the Billing page. Canceling stops the renewal; it can be withdrawn until the end of the paid period. The period that has started is due and is not refunded; access continues until its end, then stops until you subscribe again.

Payment

Prices are those of the pricing page when you subscribe, until a change announced as set out below. They exclude VAT and other taxes, added where due from the address and the tax ID given at checkout: a business in France pays French VAT; a business elsewhere in the European Union with a valid VAT number pays none, under the reverse charge; a business outside the European Union pays no French VAT. Each invoice is paid on issue, by the card on file, through Stripe, which handles payments, payment methods and invoices. A sum unpaid when due bears late-payment interest at three times the French legal interest rate, and a fixed indemnity of €40 for recovery costs (French Commercial Code, articles L441-10 and D441-5).

Failed payments

Access follows the paid period. An unpaid proration changes nothing: access continues until the end of the period already paid. An unpaid renewal, or an unpaid first payment at the end of the trial, blocks access from the start of the new period until it is paid; the owners are told by email and can pay from the Billing page. The rights and quota of a new paid period are granted only once its payment is confirmed.

Suspension and termination

We may suspend access at once when it threatens the service or its security. If a workspace breaches these terms, we may end its subscription 15 days after an email notice left without effect.

Your data

  • What your workspace saves (estimates, declarations, portfolios) is kept as long as the workspace exists, with a proof bundle to download for each saved estimate. While the workspace is subscribed, an owner or administrator can delete any of it: it is then erased, and leaves our backups within seven days. This retention is not a legal hold and does not extend beyond the life of the service: proof bundles and exports let you keep your own copies.
  • Canceling deletes nothing: the workspace and its saved estimates are kept. Without an active subscription, its pages wait for a new one, but its owner can still download, from the Billing page, its saved estimates and declarations, their proof bundles and its portfolios; for anything else it holds, ask us, and we export it free of charge. Subscribing again restores access to everything kept. A workspace without a subscription for three years is deleted; its owners are told by email a month before. A workspace whose plan was never chosen holds nothing and is deleted 30 days after its creation.
  • The owner can delete the workspace at any time, even without a subscription, after a warning and an offer to export. Deleting it cancels its subscription at once, without refund; its saved estimates and proof bundles are erased, and leave our backups within seven days.
  • How personal data is used is set out in the privacy policy. For the personal data your workspace holds, TariffTrust acts as your processor under the data processing addendum, which forms part of these terms.

Switching to another provider

You may leave TariffTrust for another provider or for your own systems, or have your data erased, as the EU Data Act provides. What can be exported: saved estimates and declarations (JSON lines, one per line, with its inputs and its result), proof bundles (ZIP: the estimate and its PDF, its sources and the checksums that identify it), portfolios and their products (CSV, one product per line), and, on request, everything else your workspace holds (settings, default answers, assistant conversations, support cases, audit log), in a structured, machine-readable format. Ask us with at most two months' notice: during a transition period of up to 30 days the service keeps running and we help you; your data stays available for at least 30 days after it, then is erased in full and the contract ends, as we tell you. Switching and exporting are free of charge. Our infrastructure is in the United States, with Amazon Web Services, and subject to US law.

Ownership

The official texts are public. TariffTrust's software, interpretations and presentation are ours; your subscription lets your business use them. Your data is yours. When we confirm an error you reported, the inputs and the correct result of that estimate, without your references, may become a test case of our engine, kept after your data is deleted.

Changes

We may change these terms and our prices. We announce a change by email to the workspace owners at least 30 days before it applies; a new price applies from the next renewal. If you refuse a change, cancel before it applies. Earlier versions are available from legal@tarifftrust.com.

Enterprise

Enterprise terms, prices and quotas are agreed in a separate contract.

Governing law and disputes

These terms are governed by French law. Before any action, write to legal@tarifftrust.com: we look for an amicable solution within 30 days. Failing one, the dispute goes to the competent courts for our address in France, even with several defendants or for urgent proceedings.

Formation

Between professionals, articles 1127-1 (1° to 5°) and 1127-2 of the French Civil Code do not apply. If a clause is held invalid, the others remain.
